1. Introduction

Welcome to FURIA!

These Terms of Use set out the rules and regulations that you must accept and comply with when accessing and using FURIA’s website, available at furia.gg and us.furia.gg (the “Platform”). By accessing the website, you represent that you have read, understood, and fully accepted the present terms and conditions of this page. If you do not agree, you must immediately discontinue browsing and use of the Platform.

For ease of understanding of these Terms of Use, whenever the terms ‘FURIA’, ‘we’, or ‘our’ appear, they refer to the owner of the Platform. Whenever you read ‘user’, ‘you’, ‘your’, or ‘yours’, they refer to you, our customer or Platform user.

2. General Information About the Platform and Its Operation

2.1. The Platform is managed by FURIA ESPORTS LTDA., registered with the CNPJ/MF under no. 28.821.144/0001-28, together with FURIA ESPORTS LLC, registered with Tax ID no. 35-2637573 (collectively, “FURIA”).

2.2. The purposes of this Platform are: to provide institutional and informational content about FURIA, including history, teams, lineups, results, and achievements, as well as to redirect users to FURIA’s official channels.

2.3. This Platform does not register users and does not require the creation of an account to access its content.

3. Your Obligations

3.1. By accessing the Platform, you declare and warrant, in an ethical and lawful manner, on your own behalf, your commitment to comply with the conditions of use. The following conduct is strictly PROHIBITED:

  • engaging in any form of harassment, bullying, offenses, discrimination, racism, xenophobia, homophobia, hate speech, toxic behavior, or similar conduct;
  • using the Platform for illegal, defamatory, obscene, pornographic, or discriminatory purposes, or for any purpose that violates third-party rights or causes any harm or offense to the image and reputation of FURIA;
  • committing or promoting crimes or unlawful acts, such as child exploitation, racism, bullying, stalking, use of narcotics, fraud, theft, or similar offenses;
  • providing incorrect, misleading, defamatory, or slanderous information and/or data;
  • accessing the programming areas of the Platform;
  • manipulating or attempting to manipulate information made available on the Platform;
  • exploiting any security gap, bug, or flaw that interferes with or compromises the integrity of the Platform or its security, its servers, or networks connected to the Platform;
  • using the Platform to disseminate spam, malware, or any other malicious content;
  • attacking the Platform through software;
  • attempting to circumvent the Platform’s security measures;
  • using the Platform by fraudulent means;
  • sharing login credentials, passwords, and accounts with third parties;
  • engaging in political campaigning or third-party advertising;
  • performing or enabling reverse engineering;
  • using data mining applications or similar tools of any type or kind;
  • publishing any material from the Platform on any other media;
  • selling, sublicensing, and/or commercializing any material or product from the Platform; and
  • executing and/or publicly displaying any material from the website without the appropriate authorization and attribution.

3.2. You are solely responsible for the accuracy and truthfulness of the information entered on the Platform, and shall be civilly and criminally liable for any consequences arising from the improper use of third-party information or the provision of false information.

3.3. This Platform is freely accessible and does not require user registration or the creation of a user account. To access FURIA’s community channels (such as WhatsApp and Discord) or the official store (shop.furia.gg), you will be redirected to third-party platforms that have their own registration and use rules. Should any future form of identification be required, the applicable rules will be communicated at that time.

3.4. Should there be reason to believe that you are breaching or facilitating a breach of these Terms of Use, or should there be suspicion of inaccurate information and/or criminal conduct, FURIA may, at its sole discretion, delete or suspend your Platform access account.

3.5. Any breach of the provisions of these Terms of Use may give rise to civil and criminal liability, where applicable.

4. FURIA’s Obligations

4.1. FURIA always seeks to employ the best available mechanisms and technologies to keep the Platform secure; however, the virtual environment is subject to malicious acts by third parties.

4.2. FURIA endeavors to offer continuous and uninterrupted availability of the Platform. Nonetheless, the Platform is susceptible to extraordinary force majeure events such as natural disasters; failures or collapses in central communication systems and internet access; or third-party events. None of these events shall be attributable to FURIA, which undertakes to use its best efforts to ensure the prompt restoration of the Platform.

4.3. FURIA shall not be liable for any damage, loss, or harm that may have been caused to your equipment as a result of:

  • suspension or interruption of Platform operations;
  • data transmission issues, including data loss;
  • operations on third-party platforms to which the Platform redirects, including, without limitation, WhatsApp, Discord, the official store (shop.furia.gg), Instagram, X/Twitter, TikTok, Facebook, and YouTube;
  • third-party events, including viruses or malicious programs transmitted by third parties, hackers, system, server, or internet connection failures;
  • issues, failures, or malfunctions occurring in your devices or equipment;
  • any events beyond FURIA’s control; and/or
  • any scheduled maintenance procedures.

4.4. FURIA is not responsible for the content, availability, security, or privacy practices of third-party platforms to which this Platform provides links or redirects, including, without limitation: WhatsApp, Discord, the official FURIA store (shop.furia.gg), Instagram, X/Twitter, TikTok, Facebook, and YouTube. Such platforms are operated independently and have their own Terms of Use and Privacy Policies, for which FURIA is not responsible. By accessing any third-party platform through a link made available on this Platform, you do so at your own risk and subject to that platform’s rules.

4.5. Under no circumstances shall FURIA, its affiliates, or any of its executives, directors, employees, and/or staff be held liable for any indirect, consequential, or special event arising from or in any way related to the use of the Platform. FURIA shall be liable only for proven direct and material damages attributable to FURIA, with lost profits or other non-material damages expressly excluded.

4.6. FURIA does not assume liability or provide warranties regarding the use of the Platform or its content.

5. Privacy and Data Protection

5.1. At FURIA, we take the privacy and protection of your personal data very seriously. To that end, we have prepared a Privacy Policy to clarify how your data is collected and processed. Should you have any questions, require further information, or wish to report a privacy incident, please contact us at lgpd@furia.gg.

6. Intellectual Property Rights

6.1. FURIA, its affiliates, and/or its licensors hold all intellectual property rights over all material and content made available on the Platform, including information, images, videos, trademarks, trade names, domain names, source code, databases, networks, files, and other data available on the Platform. All intellectual property rights are reserved. You may view and/or print pages from the Platform for your personal use, subject to the restrictions set forth in these Terms of Use.

6.2. Your use of the Platform does not give rise to any presumption of transfer or licensing of ownership over its content. Accordingly, any reproduction, in whole or in part, of the content available on the Platform for purposes not expressly authorized in these Terms of Use is prohibited, and its use for commercial, advertising, or any other purposes inconsistent with the purpose for which it was created is strictly forbidden.

6.3. The photos and images used on the Platform may not reflect the actual size or current state of the depicted scenes or products, and are provided for illustrative purposes only.

6.4. Should you upload content to the Platform (such as photos, images, and personal comments relating to a product), you automatically authorize its reproduction, use, and disclosure on the Platform or in other media, on a non-exclusive, royalty-free, and immediate basis, for the sole purpose of promoting the product to which it relates, in order to showcase the experience you obtained from using the product. You may, at any time, choose to revoke the authorization granted by submitting a formal request to FURIA through our support channels.

7. Content

7.1. In these Terms of Use, “Content” means any audio, video, text, images, or other material that you choose to display on the Platform. By displaying Content, you grant FURIA a non-exclusive, royalty-free, irrevocable, and sublicensable worldwide license to use, reproduce, adapt, publish, translate, and distribute it across any and all media. The Content must be yours and must not infringe the rights of any third party. FURIA reserves the right to remove any content from the website at any time without prior notice.

7.2. You are solely responsible for the accuracy and truthfulness of the information and Content, and shall be civilly and criminally liable for any damages caused thereby.

7.3. Under no circumstances shall FURIA be held liable for user-generated content on the Platform, including with respect to errors and omissions or losses suffered as a result of the use of user-generated content.

7.4. FURIA reserves the right to retain a copy of the Content for audit purposes and to preserve third-party rights.

7.5. This Platform is informational and institutional in nature. User interactions such as messages and comments take place on third-party platforms to which this Platform redirects (WhatsApp, Discord, social media), and are subject to the respective terms of those platforms.

7.6. Content may be deleted from the Platform at FURIA’s sole discretion.

8. Communications

Electronic communications: By communicating with us through any channel indicated on this Platform, you authorize us to respond to you through the same electronic means.

9. No Warranties

This website is provided “as is,” with all faults, and FURIA makes no representations or warranties of any kind in relation to this website or the materials contained herein. Furthermore, nothing contained on the Platform shall be construed as a notice or advisory.

10. Indemnification

You shall fully indemnify the Platform from and against any and all liabilities, costs, demands, causes of action, damages, and expenses arising in any way from a breach of any of the provisions of these Terms of Use.

11. Severability

If any provision of these Terms of Use is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms of Use unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

12. Variation of Terms

FURIA reserves the right to modify these Terms of Use at any time without prior notice. Amendments shall take effect on the date of their publication on the Platform. Continued use of the Platform following publication of amendments constitutes acceptance of the new Terms of Use. You are expected to review these Terms of Use regularly to ensure you understand all the rules governing the use of this Platform.

13. Assignment

FURIA shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms of Use without any prior notice or consent from the user. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms of Use.

14. Entire Agreement

These Terms of Use, including any legal notices and disclaimers contained on this Platform, constitute the entire agreement between FURIA and you with respect to the use of the Platform, and supersede all prior agreements and understandings relating to the same subject matter. By using the Platform, you agree to these Terms of Use and agree to comply with them.

15. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. They shall be interpreted in the Portuguese language. The Judicial District of São Paulo, in the State of São Paulo, is hereby elected as the competent forum to resolve any disputes or matters arising from these Terms of Use.
